User Agreement
To use the YANDOCTOR Client Software (hereinafter referred to as "The Software") and services, you should read and abide by the License and Service Agreement of YANDOCTOR Client Software (hereinafter referred to as "this Agreement") and the Service Agreement of YANDOCTOR Client. Please carefully read and fully understand the terms and conditions, especially those concerning exemption or limitation of liability, as well as the separate agreement for opening or using a service, and choose to accept or not accept the terms and conditions. Limitations and disclaimers may be in bold for your attention.
Unless you have read and accepted all terms of this Agreement, you have no right to download, install or use the Software and its related services. By downloading, installing, using, obtaining client account and logging in, you shall be deemed to have read and agreed to be bound by the above agreement.
If you are under the age of 18, please read this agreement and other above agreements in the presence of a legal guardian, paying special attention to the terms of use for minors.
I. Scope of the Agreement
1.1 Subject range applicable to the protocol
This Agreement is an agreement between you and Doctor Yan regarding your downloading, installation, use and copying of the Software and the use of related services of Doctor Yan.
1.2 Relationship and terms of conflict
This Agreement shall be regarded as a supplementary agreement to the Service Agreement of Doctor Yan and shall be an integral part of the Agreement and shall constitute a unified whole. In case of any conflict between this Agreement and the above contents, this Agreement shall prevail.
This Agreement shall also include agreements, business rules and other contents related to the Service that May be continuously released by Doctor Yan. The above content, once officially released, shall form an integral part of this Agreement and shall be observed by you.
Ii. About the Service
2.1 Contents of the Service
This service refers to the yan doctor cross-platform tools provided to the user (hereinafter referred to as the "yan doctor client"), support equipment transmission image to APP on the basis of function, at the same time to provide users with including but not limited to the chain development, convenient tool, yan doctor client public account, open platform, and other functions or content of the software license and services (hereinafter referred to as "the services").
2.2 Form of the Service
2.2.1 Your use of the Service requires you to download Doctor Yan's client software, for which Doctor Yan grants you a personal, non-transferable and non-exclusive license. You may use the Software and its services only for the purpose of accessing or using the Service.
2.2.2 In the Service, Doctor Yan client software provides multiple application versions, including but not limited to ios, Android and other application versions. Users must select the software version that matches the terminal device installed.
2.3 Scope of license for the Service
2.3.1 Dr. Yan gives you a personal, non-transferable and non-exclusive license to use the Software. You can install, use, display, and run the software on a single terminal for non-commercial purposes.
2.3.2 You may make a copy of the Software for the purpose of using the Software and services, only for backup. The backup copy must contain all copyright information contained in the original software.
2.3.3 All other rights not expressly authorized by this clause and other terms of this Agreement shall be reserved by Doctor Yan, and you shall obtain written permission from Doctor Yan to exercise such rights. The failure of Dr. Yan to exercise any of the foregoing rights shall not constitute a waiver of such rights.
Third, software acquisition
3.1 You may obtain the software directly from Doctor Yan's website or from a third party authorized by Doctor Yan.
3.2 If you obtain the Software or an installation program with the same name as the software from a third party not authorized by Doctor Yan, Doctor Yan cannot guarantee the normal use of the software and shall not be responsible for any loss caused to you.
Iv. Software installation and uninstallation
4.1 Doctor Yan may develop different software versions for different terminal devices. You should download the appropriate version for installation according to the actual situation.
4.2 After downloading the installation program, you need to follow the steps prompted by the program to install it correctly.
4.3 In order to provide better and safer services, Doctor Yan may recommend you to install other software when installing this software. You may choose to install it or not.
4.4 If you no longer need to use this software or need to install new software, you can uninstall it by yourself. If you are willing to help Yan Dafu improve the products and services, please inform us of the reason for unloading.
V. Update of software
5.1 In order to improve user experience and service content, Doctor Yan will constantly strive to develop new services and provide you with software updates (which may take the form of software replacement, modification, modification, function enhancement, version upgrade, etc.).
5.2 In order to ensure the security and functional consistency of the Software and services, Doctor Yan has the right to update the Software or change or restrict some functions of the Software without special notice to you.
5.3 After a new version of the software is released, the old version of the software may become unavailable. Doctor Yan does not guarantee the continued availability of the old version of the software and the corresponding customer service, please check and download the latest version at any time.
Vi. Protection of users' personal information
6.1 The protection of users' personal information is a basic principle of Doctor Yan, and Doctor Yan will take reasonable measures to protect users' personal information. Except as stipulated by laws and regulations, Doctor Yan will not disclose or disclose user's personal information to any third party without user's permission. Doctor Yan uses professional encrypted storage and transmission methods to ensure the security of users' personal information.
6.2 When registering an account or using the Service, you are required to provide some necessary information, for example, you are required to fill in your mobile phone number in order to provide you with the account registration service or perform user identity identification. You are required to provide your true identity if required by national laws, regulations or policies. If the information you provide is incomplete, you will not be able to use the Service or your use will be restricted.
6.3 In general, you may browse and modify the information submitted by yourself at any time. However, for security and identity purposes, you may not be able to modify the initial registration information and other verification information provided during registration.
6.4 Doctor Yan will use various security technologies and procedures to establish a sound management system to protect your personal information from unauthorized access, use or disclosure.
6.5 Without your consent, Doctor Yan will not disclose your personal information to any company, organization or individual other than Doctor Yan, except as otherwise provided by laws and regulations.
6.6 Doctor Yan attaches great importance to the protection of minors' personal information. If you are a minor under the age of 18, you should obtain the written consent of your parents or legal guardian before using the services of Doctor Yan.
Clause of Sovereign Rights and Obligations
7.1 Precautions for Users
7.1.1 You understand and agree that in order to provide you with effective services, the Software will utilize the processor and bandwidth resources of your terminal device. During the use of the software, there may be charges for data flow. Users need to learn the relevant tariff information from the operators and bear the relevant charges by themselves.
7.1.2 You understand and agree that certain functions of the Software may allow a third party to know the user's information, for example, the user's Friend on the Yan Dafu client can query the user's profile picture, name, Yan Dafu client number or moments of friends and other personal information that can be disclosed; If a user uses a mobile phone number to register the client account of Doctor Yan or the mobile phone number is associated with the client account of Doctor Yan, the client account of Doctor Yan can be queried by the friends with the number in the address book.
7.1.3 When you use a specific service of the Software, there may be a separate agreement and relevant business rules for such service (hereinafter collectively referred to as the "Separate Agreement"). Please read and agree to the relevant separate agreement before using the service.
7.1.4 You understand and agree that Doctor Yan will use reasonable commercial efforts to ensure the storage security of your data in the Software and Services. However, Doctor Yan cannot provide complete guarantee for this, including but not limited to the following:
7.1.4.1 Doctor Yan shall not be responsible for your failure to delete or store relevant data in the Software and services;
7.1.4.2 Doctor Yan shall have the right to determine the maximum storage period of a single user's data in the Software and services according to the actual situation, and allocate the maximum storage space for the data on the server. You can back up the data in the software and service according to your own needs;
7.1.4.3 If you stop using the Software and services or the Services are terminated or cancelled, Doctor Yan may permanently delete your data from the Services. Dr Yan shall not be obliged to return any data to you after the service ceases, terminates or cancellations. All losses caused thereby shall be borne by the user himself.
7.1.5 When using the software and services, users shall bear the following risks beyond the control of Yan Doctor, including but not limited to:
7.1.5.1 Personal information loss, disclosure and other risks caused by force majeure;
7.1.5.2 The user must select the software version that matches the terminal device to be installed. Otherwise, any problems or damage caused by the software model mismatch with the terminal device shall be borne by the user;
7.1.5.3 When users use the software to access third-party websites, the risks that may be caused by the third-party websites and related content shall be borne by users themselves;
7.1.5.4 Risks and liabilities arising from the reposting, sharing and dissemination of the content posted by users by others;
7.1.5.5 Yan Doctor client login failure, incomplete data synchronization, slow page opening and other risks caused by unstable wireless network signal, small wireless network bandwidth, etc.
7.2 Third-party Products and Services
7.2.1 When you use the products or services provided by a third party of the Software, you shall comply with the user agreement of the third party in addition to the provisions hereof. Doctor Yan and the third party shall bear their respective liabilities for any possible disputes within the scope prescribed and agreed by law.
7.2.2 for users to use the software or ask yan doctor to provide specific services, this software may be called the third party system or through a third party or support the use of user access, the result of the use or access is provided by the third party, yan doctor does not guarantee that through a third party to provide the service and content of safety, accuracy, effectiveness and other uncertain risks, Doctor Yan shall not be responsible for any disputes and damages arising therefrom.
7.2.3 you understand and agree that yan doctor has the right to decide to this software for commercial purposes, including but not limited to the development, the use of the software part of the service to third parties for promotion, such as yan doctor if bearing in the process of popularization in strict accordance with this agreement to protect your personal information, at the same time you also can choose according to system Settings screen, refused to receive relevant information.
Viii. User behavior specification
8.1 Information Content Specification
8.1.1 The information content mentioned in this article refers to any content produced, copied, released or disseminated by users during the use of the Software and services, including but not limited to videos, pictures or content generated by the use of yan Doctor client or the software and services.
8.1.2 you understand and agree that yan doctor client has been committed to providing civilization health, standard and orderly network environment, you may not use the yan doctor client software and services to produce, copying, distribution, dissemination, the following interfere with the normal operation, yan doctor client and infringing on lawful rights and interests of other users or the third party content, including but not limited to:
8.1.2.1 Publishing, transmitting, disseminating or storing contents prohibited by national laws and regulations:
(1) Violation of the basic principles defined in the Constitution;
(2) Endangering state security, divulging state secrets, subverting state power or undermining national unity;
(3) Harming national honour and interests;
(4) Inciting ethnic hatred, ethnic discrimination or undermining ethnic unity;
(5) Sabotaging the state's religious policy or promoting cults and feudal superstitions;
(6) walking rumors, disturbing social order and undermining social stability;
(7) walking with obscenity, eroticism, gambling, violence, terror or abetting a crime;
(8) Insulting or slandering others or infringing upon the legitimate rights and interests of others;
(9) Inciting illegal assembly, association, procession, demonstration or gathering people to disturb public order;
(10) Carrying out activities in the name of an illegal non-governmental organization;
(11) Fail to comply with the Interim Regulations on the Development and Administration of Instant Messaging Public Information Service and the "seven bottom lines" requirements of laws and regulations, the socialist system, national interests, citizens' legitimate interests, public order, social morals and customs, and information authenticity;
(12) Other contents prohibited by laws and administrative regulations.
8.1.2.2 Publish, transmit, disseminate or store contents that infringe on other people's right of reputation, right of portrait, intellectual property rights, business secrets and other legal rights;
8.1.2.3 Privacy, personal information or data of others is involved;
8.1.2.4 Publish, transmit or spread harassment, advertising or spam information or any sexual or sexual implication;
8.1.2.5 Other information that violates laws, regulations, policies, public order, good customs, social ethics, or interferes with the normal operation of Yan Dafu client or infringes on the legitimate rights and interests of other users or third parties.
8.2 Software Usage Specifications
Unless permitted by law or authorized by Doctor Yan in writing, you shall not do the following when using the software:
8.2.1 Delete the copyright information in the software and its copies;
8.2.2 Reverse engineer, reverse assemble, reverse compile the software, or try to discover the source code of the software in other ways;
8.2.3 Use, rent, lend, copy, modify, link, reprint, compile, publish, publish and establish mirror sites for the contents with intellectual property rights owned by Doctor Yan;
8.2.4 Copy, modify, add, delete, mount, run or create any derivative works of the software or the data released into the memory of any terminal, the interactive data between the client and the server during the operation of the software, and the system data necessary for the operation of the software. The form includes but is not limited to using plug-ins, plug-ins or third-party tools/services not authorized by Doctor Yan to access the software and related systems;
8.2.5 Add, delete or change the functions or operating effects of the Software by modifying or falsifying instructions and data in the operation of the Software, or operate or disseminate to the public the software and methods used for the above purposes, whether for commercial purposes or not;
8.2.6 Log in to or use the Software and services of Doctor Yan through third-party software, plug-ins, plug-ins and systems not developed or authorized by Doctor Yan, or make, publish or disseminate the tools mentioned above;
8.2.7 Interference with the Software and its components, modules and data by the third-party software itself or authorized by others;
8.2.8 Any other act without the express authorization of Doctor Yan.
8.3 Service Operation Specifications
Unless permitted by law or authorized by Doctor Yan in writing, you shall not do any of the following when using the Service:
8.3.1 Submit or publish false information, or impersonate or use the name of others;
8.3.2 Inducing other users to click on linked pages or share information;
8.3.3 Fabricating or concealing facts to mislead or deceive others;
8.3.4 Infringe upon the legitimate rights of reputation, portrait, intellectual property and business secrets of others;
8.3.5 Use The client account and any functions of Doctor Yan, as well as third-party operating platforms to promote or promote each other without the written permission of Doctor Yan;
8.3.6 Use the Client account of Doctor Yan or the software and services to engage in any illegal or criminal activities;
8.3.7 Make or publish methods and tools related to the above activities, or operate or disseminate such methods and tools, whether these activities are for commercial purposes or not;
8.3.8 Any other act that violates laws, infringes upon the legitimate rights and interests of other users, interferes with the normal operation of the product or is not expressly authorized by Doctor Yan;
8.4 Take responsibility for your own actions
You fully understand and agree that you are responsible for all your actions in relation to the use of the Software, including any content you publish and any consequences arising therefrom. You shall use your own judgment on the content in the Service and assume all risks arising from the use of the Content, including risks arising from reliance on the correctness, completeness or practicality of the Content. Doctor Yan cannot and will not be liable for any loss or damage caused by the foregoing risks.
8.5 Handling of Breach

8.5.2 you understand and agree that yan doctor shall have the right to according to the reasonable judgment of violation of the relevant laws and regulations or the provisions of this agreement for punishment, in violation of any user to take appropriate legal action, according to the laws and regulations to save the information reported to the relevant departments, such as user alone shall bear all the legal responsibilities arising therefrom.
8.5.3 You understand and agree that you shall be solely liable for any claim, demand or loss claimed by a third party resulting from your breach of the Provisions of this Agreement or the relevant Terms of Service; If Doctor Yan has suffered any losses as a result, you should also compensate the company for all the losses.
Ix. Declaration of Intellectual Property Rights
9.1 Yan Doughshi is the owner of intellectual property rights of the software. All the software copyright, trademarks, patents, trade secrets and other intellectual property rights, and all of the information content associated with the software (including but not limited to text, images, audio, video, graphics, interface design, layout, framework and relevant data or electronic documents, etc.) are affected by the laws and regulations of the People's Republic of China and the relevant international treaties to protect, Doctor Yan shall enjoy the above-mentioned intellectual property rights, except for the rights that the relevant right holder shall enjoy in accordance with the law.
9.2 Without the written consent of Doctor Yan or the relevant right holder, you shall not, or permit any third party to, enforce, exploit or restate the intellectual property for any commercial or non-commercial purpose.
X. Responsibility for terminal security
10.1 You understand and agree that, like most Internet software, the Software may be affected by various factors, including but not limited to user reasons, network service quality, social environment, etc. They may also be harassed by various security issues, including but not limited to the illegal use of user information by others to carry out real-life harassment; Other software downloaded and installed by users or other websites visited may contain viruses, Trojan horses or other malicious programs, which may threaten the security of your terminal information and data, and then affect the normal use of the software. Therefore, you should strengthen the awareness of information security and personal information protection, pay attention to password protection, in order to avoid losses.
10.2 You shall not make, publish, use or spread malicious programs that are used to steal The client account of Doctor Yan and other people's personal information and property.
10.3 Dr. Yan and you are jointly responsible for maintaining the software security and normal use. Dr. Yan will take reasonable and prudent technical measures to protect the security of your terminal information and data in accordance with industry standards. However, you acknowledge and agree that Dr. Yan cannot provide complete guarantee in this regard.
10.4 Under no circumstances should you trust any Internet information that involves borrowing money, asking for passwords or other property. Design property operation, please be sure to verify the identity of the other party, and please always pay attention to doctor Yan on the prevention of fraud crime tips.
11. Third-party software or technology
11.1 The Software may use third-party software or technology (including the open source code and public domain code that may be used by the software, the same below), and such use has been legally authorized.
11.2 If the software uses third-party software or technology, Doctor Yan will display the relevant agreement or other documents in the form of attachments to the Agreement, packaging in a specific folder of the software installation package, or through the open source software page in accordance with relevant laws and regulations or agreements. They may be expressed as "Software License Agreement," "License Agreement," "Open source license," or some other form. The foregoing agreements, other documents and web pages displayed in various forms are an integral part of this Agreement and shall have the same legal effect as this Agreement and you shall comply with these requirements. If you fail to comply with these requirements, such third party or state authority may impose charges, fines or other sanctions against you and require Dr. Yan's assistance, and you shall be held liable.
11.3 Any dispute caused by the software or technology used by a third party shall be settled by such third party, and Doctor Yan shall not bear any responsibility. Doctor Yan does not provide customer service support for third-party software or technologies. If you need support, please contact the third party.
11.4 Some third-party applications may be included or downloaded to the mobile device. Dr. Yan does not list any such apps. As Doctor Yan has no control over such third-party applications, you acknowledge and agree that Doctor Yan shall not be responsible for the availability of such applications and shall not be responsible for the data, content, advertisements, products, services or other information used by its suppliers. You expressly acknowledge and agree to be solely responsible for the risks associated with the use of such third-party applications and any problems arising from unsatisfactory use, quality, performance, accuracy and difficulty in use. It is your discretion to take precautionary measures to ensure that the third party application you choose does not contain viruses, worms, Trojan horses, or other damaging content. The names, tags, products or any services of third party applications or their suppliers referenced on the Device are solely for your convenience and do not imply any endorsement, sponsorship, recommendation or affiliation with third party products or services. You agree that Doctor Yan shall not be liable, directly or indirectly, for any damage or loss, including but not limited to equipment damage or data loss, caused or suspected to be caused by using or relying on the available content, products or services of such third party applications. You acknowledge and agree that your use of a third party Application shall be subject to any terms of Use, License Agreement, Privacy Measures or other such agreement that may exist from such third party Application provider. If you knowingly or unintentionally provide any information and personal data provided by such third-party application, you shall comply with the privacy protection measures that may exist with such third-party application provider. Doctor Yan hereby disclaims responsibility for any data disclosure or any other practices of third-party application providers. At the same time, Doctor Yan shall not be liable for any information about whether your personal information has been captured by any third party application provider and any possible use of such personal information by such third party application provider.
Xii. Others
12.1 When you use the Software, you shall be deemed to have read and agree to be bound by this Agreement. Dr. Yan has the right to modify the terms of this Agreement if necessary. You can check the terms of the agreement in the latest version of this software. If you continue to use the software after the terms of this Agreement are changed, you shall be deemed to have accepted the revised agreement. If you do not accept the revised agreement, you should stop using the software.
12.2 This Agreement is signed in Taizhou city, Zhejiang Province, the People's Republic of China.
12.3 The formation, entry into force, performance, interpretation and dispute settlement of this Agreement shall be governed by the laws of the mainland of the People's Republic of China (excluding conflict of laws).
12.4 Any dispute or dispute between you and Dr. Yan shall be settled through friendly negotiation. If negotiation fails, you agree to submit the dispute to the competent people's court in the place where this agreement is signed.
12.5 The headings of all terms hereof are for convenience only and have no actual meaning and shall not be used as the basis for the interpretation of the meaning hereof.
12.6 No matter the terms of this Agreement are partially invalid or unenforceable for whatever reason, the remaining terms shall remain valid and binding on both parties. (End of text)
